Perceptual experience and visual imagination both offer a first-person perspective on visible objects. But these perspectives are strikingly different. For it is distinctive of ordinary perceptual intentionality that objects seem to be present to the perceiver. I term this phenomenal property of experience ‘presence’. This paper introduces a positive definition of presence. Dokic and Martin (2017) argue that presence is not a genuine property of perceptual experience, appealing to empirical research on derealisation disorders, Parkinson’s disease, virtual reality and hallucination. Mohan Matthen holds that visual perceptual content is divided into descriptive and referential elements. Descriptive content is our awareness of sensory features belonging to objects located in the visual field. Matthen conceives of this in terms of an image. The referential element is a demonstrative form of content, by which we pick out those objects as particulars and assert their physical presence. Matthen terms this ‘the feeling of presence’. Together, they make up the ‘assembled message’ that visual states present to (...) the perceiver in perceptual experience. I argue that the two elements cannot play together as Matthen envisages. Beginning with the referential element, I show that the feeling of presence is unable to both provide demonstrative reference and assert that the visual state reflects how things are. Turning to the descriptive element, I argue that Matthen is committed to a view on which descriptive (or image) content is a mental entity, a reified image. This is a common element across perceptual experience, episodic memory and visual imagination. The mental entity proves a defective ingredient in assembling perceptual content that purports to present reality. There are problems integrating the depicted viewpoint with the subject’s actual viewpoint, and problems maintaining a coherent notion of assertion. O artigo visa identificar traços da fenomenologia de Max Scheler na obra de Henrique Cláudio de Lima Vaz. Pretende-se aprofundar a compreensão do pensamento deste filósofo brasileiro ainda pouco estudado através da aproximação de outras fontes filosóficas implícitas em sua sua escritura ética. No primeiro passo, trata-se de investigar a influência do personalismo moral de Scheler sobre a questão ética em Lima Vaz. To write of “the” philosophy of transhumanism is a little daring. The growth of transhumanism as a movement and philosophy means that differing perspectives on it have formed.

In their contribution ‘Ethics of the algorithmic prediction of goal of care preferences’1 Ferrario et al elaborate a from theory to practice contribution concerning the realisation of artificial intelligence (AI)-based patient preference prediction (PPP) systems. Such systems are intended to help find the treatment that the patient would have chosen in clinical situations—especially in the intensive care or emergency units—where the patient is no longer capable of making that decision herself. The authors identify several challenges that complicate their effective development, (...) application and evaluation—and offer solutions to them. One of these issues is the question of who should ultimately use said systems. While it is undisputed that clinicians should use these AI systems for their decision-making process, there is an ongoing debate about whether next of kin should use them as well. The authors advocate that ‘’access should be provided to both clinicians and loved ones with due explanations and as desired’. We will disagree with this assessment and explain in our commentary why it is important that surrogates provide their own assessments with as little external (AI) influence as possible. In the past, it was possible to approach transhumanism as primarily involving philosophical discussion and technological speculation. While transhumanist goals such as radical life extension, uploading, and cognitive, sensory, and physical enhancement were speculative they were also considered scientifically feasible, even if the technologies to achieve those goals appeared remote.

In his contribution, ‘Represent me: please! Towards an ethics of digital twins in medicine’1, Braun shows that there is a fundamental ambivalence inherent in digital twins: they can either open up new freedoms for the simulated persons, or, conversely, endanger and restrict their freedom. To prevent digital twins from restricting people’s freedom, Braun suggests a strong focus on control. Braun’s focus on control is insufficient, I will argue, because his idea of control works only retroactively: it can only react to (...) restrictions of freedom that have already occurred, but it cannot prevent them, nor can it restore any lost freedom. Control is therefore insufficient to defend people’s freedom. To prove my claim, I will first use an everyday example to illustrate the fundamental ambivalence inherent in digital twins. Second, I will show that digital twins endanger people’s freedom in a hermeneutic way. Finally, I will demonstrate why controllability cannot prevent this hermeneutic endangerment. I understand digital twins, like Braun, as simulation of a person, as their dynamic and precise effigy. Simulated twins use machine-learning and artificial intelligence capabilities to make predictive analyses about the simulated person and the future development of her health. Imagine: You are eating dinner. Meanwhile, your partner lectures you about the calorie density and nutrient composition of your food, warns you that your portion size exceeds your daily calorie requirement by x calories. It calculates how your dinner will negatively impact your body mass index and physical fitness, and predicts what the consequences will be for your overall health. Based on these data and predictions, it creates an individualised diet plan for you—and at the same time shows you by how much you could improve your vital values by sticking to that plan. This paper develops a critique of the concept of ‘ethical identity’ as this has been used recently to distinguish between ‘cynical’ and ‘authentic’ forms of corporate responsibility. Taking as our starting point Levinas’ demanding view of responsibility as ‘following the assignation of responsibility for my neighbour’, we use a case study of a packaging company—PackCo—to argue that a concern with being seen and/or seeing oneself as responsible should not be confused with actual responsibility. Our analysis of the case points first (...) to the allure of programmes of strategic corporate responsibility and the ways in which, through identification, they can provide a tacit form of moral sanction to managers in their aggressive pursuit of profit. It then contrasts the responses of different managers to negative staff feedback to illustrate the difference between managers’ attempts to defend their identity of being ‘responsible’ managers, and responsible conduct itself. The paper concludes that a potent danger of programmes of corporate responsibility is that they allow managers to deceive not just others, but also themselves in relation to the exercise of responsibility. Resumo: Esse ensaio buscará sondar as relações entre filosofia e literatura, no pensamento de Gilles Deleuze, a despeito de sua parceria conjunta com Félix Guattari, atentando tanto para as concepções de escrita expressas ao longo de sua obra quanto para o modo como essas concepções teriam influenciado o estilo de seus escritos filosóficos. Partindo da premissa deleuziana de que a escrita possui um acentuado lastro clínico, sendo a responsável pela elaboração de um diagnóstico das forças capazes de aprisionar ou calar (...) a vida, procurar-se-á esmiuçar as ressonâncias desse lastro clínico, na concepção de filosofia como ato criativo, elaborada pelo autor. Como hipótese a ser aqui trabalhada, defende-se que a escrita deleuziana - compreendida como portadora de uma literalidade, conforme sustenta François Zourabchivili, ou como encrustada de uma poética imanentista, tal qual sugere Anita Costa Malufe - procuraria produzir uma zona de vizinhança ou indiscernibilidade entre a escrita filosófica, de caráter mais exegético, e a escrita literária, mais afectiva, de modo a produzir um deslocamento na relação do leitor com o ato de pensar.: In this essay we pretend to study the relationship between philosophy and literature in Gilles Deleuze’s thought, despite of his partnership with Félix Guattari, mapping the conceptions of writing throughout his work and considering the influence of these conceptions to forge a certain style in his philosophical texts. Starting from the deleuzian premise that writing has a strong clinical backing - being responsible for the elaboration of a diagnosis of the forces liable to imprison or silence life -, we will examine the resonances of this clinical backing in his conception of philosophy as a creative act. Our hypothesis is that the deleuzian writing - having a certain literality, as François Zourabchivili argues, or encrusted with an immanentism poetics, as Anita Costa Malufe suggests - would produce a so-called neighborhood zone or zone of indiscernibility between philosophical writing, with a more exegetical character, and literary writing, which is more affective, in order to produce a shift in the reader’s relationship with the act of thinking. Constitutional Law has undergone many changes since post World War II and its reflex has been felt in all other legal areas. However, little attention has been given to Legal Theory after these constitutional transformations. The present study discusses multiple aspects of such implications. After presenting what is understood by neoconstitutionalism, a correlation is drawn with changes in constitutional interpretation. A new element – defeasibility – is then placed as a necessary counterpoint between deliber- ating constitutional principles and the theory (...) of norms. Only if we take defeasibility into account and understand that constitutional interpretation has undergone certain changes, one is able to grasp the important tenets of neoconstitutionalism.Resumen:El derecho constitucional ha sufrido muchos cambios después de la Segunda Guerra Mundial y sus consecuencias se han manifestado en otras áreas del derecho. Sin embargo, poca atención se le ha dado a la teoría jurídica después de estos cambios constitucionales. Este estudio investiga varios descubrimientos de estas implicaciones. Después de presentar lo que se entiende por neoconstitucionalismo, se avanza una correlación con los cambios en la interpretación constitucional. Un nuevo elemento —derrotabilidad— se presenta como una contrapartida necesaria entre la deliberación de los principios constitucionales y las enseñanzas de la teoría de las normas. Sólo a través de la derrotabilidad y el entendimiento de que la interpretación constitucional ha sufrido ciertos cambios, puede uno entender uno de los grandes postulados del neoconstitucionalismo. Sobre a Certeza de Ludwig Wittgenstein carrega considerações importantes sobre como justificamos nosso conhecimento. Em particular, a obra nos apresenta às assim chamadas hinge propositions. Diante da multiplicidade de interpretações desse conceito, encontramos de maneira pervasiva a discussão sobre se elas implicariam em um fundacionismo. Se as ideias presentes nos trabalhos da fase madura de Wittgenstein são comumente consideradas anti-fundacionistas, então por que esse não seria o caso também em Sobre a Certeza? Por um lado, autores como Stroll compreendem que (...) há um tipo de proposta fundacionista. Por outro, autores como Williams defendem o anti-fundacionismo. A partir da análise de ambas as posições, argumentamos que uma leitura anti-fundacionista é mais adequada. Por fim, possibilitados pelo anti-fundacionismo, apresentamos nossa leitura antidogmática cujo objetivo é ressaltar que a obra tem como propósito nos ensinar a fazer filosofia sem ignorar ou desqualificar a diversidade de culturas e perspectivas existentes. O objetivo deste artigo é discutir o modo como Husserl desenha a originalidade da subjetividade transcendental, frente à sua homônima psicológica. Se é certo que a noção de “imanência autêntica” pode apontar para as diferentes fronteiras entre o transcendental e o psicológico, resta que por si só ela não permite decidir nada quanto ao “modo de ser” transcendental, em sua diferença face ao “mundano”. Sendo assim, procura-se reconstituir alguns dos momentos centrais do esforço husserliano para construir um conceito de “subjetivo” (...) e de “subjetividade” que não se confunda mais com o “psíquico” da psicologia tradicional.
